PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE NEWIQ™ APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THE COLLECTION, USE, AND HANDLING OF INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.


1. Introduction

This Privacy Policy ("Policy") describes how SabrinaDeliversJoy, LLC and its affiliates, subsidiaries, officers, directors, employees, agents, and successors in interest ("Company," "we," "us," or "our") collect, use, disclose, and protect information in connection with the NewIQ™ mobile application ("Application" or "App"). This Policy applies to all users of the Application ("User," "you," or "your").

We are committed to transparency regarding our data practices. The Application was designed with a privacy-first architecture — all blood gas analysis and reference value computation is performed locally on your device. We do not operate backend servers that receive, process, or store your clinical or patient data.


2. Information We Do NOT Collect

We want to be clear about the data we do not collect. The Application does not collect, store, transmit, or have access to:

All clinical data you enter into the Application exists only in your device's active memory during the current session and is not persisted to local storage, transmitted over any network, or accessible to us or any third party. When you close the Application or navigate away from an analysis, all entered data is discarded.

While the Application itself collects minimal data, certain information may be collected through the distribution platforms and standard application infrastructure:

3.3 Over-the-Air Update Services

The Application utilizes Expo Application Services ("EAS") to deliver over-the-air updates that improve functionality, fix bugs, or address security issues. When the Application checks for updates, limited technical information may be transmitted to EAS servers, including:

Because the Application does not collect or store clinical data, patient information, or user account data, there is no such data to retain or delete.

To the extent that we receive aggregated analytics or crash data from Platform services (as described in Section 3), we retain such data only for as long as reasonably necessary to fulfill the purposes described in this Policy, after which it is deleted or anonymized.

THE APPLICATION IS NOT A "COVERED ENTITY" OR "BUSINESS ASSOCIATE" AS DEFINED BY THE HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996 AND ITS IMPLEMENTING REGULATIONS ("HIPAA"). THE COMPANY DOES NOT COLLECT, RECEIVE, MAINTAIN, OR TRANSMIT "PROTECTED HEALTH INFORMATION" ("PHI") AS DEFINED BY HIPAA.

YOU ARE SOLELY RESPONSIBLE FOR ENSURING THAT YOUR USE OF THE APPLICATION COMPLIES WITH ALL APPLICABLE PRIVACY AND DATA PROTECTION LAWS, INCLUDING HIPAA, AND ALL INSTITUTIONAL POLICIES AND PROCEDURES REGARDING THE USE OF MOBILE APPLICATIONS AND REFERENCE TOOLS IN CLINICAL SETTINGS. IF YOUR INSTITUTION REQUIRES A BUSINESS ASSOCIATE AGREEMENT ("BAA") FOR APPLICATIONS USED IN CLINICAL SETTINGS, BE ADVISED THAT WE DO NOT ENTER INTO BAAs, AS THE APPLICATION DOES NOT ACCESS, PROCESS, STORE, OR TRANSMIT PHI.

Although the Application does not collect or transmit patient data, you should exercise caution when entering any information into any application in a clinical setting. Do not enter patient-identifiable information into the Application. The Application requires only clinical values (such as blood gas parameters and gestational age) and does not require or request any patient identifiers.


10. International Users

The Application is operated from the United States. If you access the Application from outside the United States, you acknowledge and agree that any limited information collected as described in this Policy may be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

If you are located in the EEA, United Kingdom, or Switzerland, the legal basis for any processing of personal information is:

11. Children's Privacy

The Application is not directed at or intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have inadvertently collected personal information from a child under 18, we will take steps to delete such information promptly. If you believe that a child under 18 has provided personal information in connection with the Application, please contact us using the information in Section 14.

The Application complies with the Children's Online Privacy Protection Act ("COPPA") to the extent applicable.


12. Third-Party Links and Services

The Application does not contain links to third-party websites or services. However, the Application is distributed through third-party Platforms (Apple App Store and Google Play Store), and updates are delivered through Expo Application Services. Each of these third parties has its own privacy practices, and we encourage you to review their respective privacy policies. We are not responsible for the privacy practices or content of any third-party service.


13. Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will update the "Last Updated" date at the top of this Policy and may notify you through the Application or the applicable Platform. Your continued use of the Application after any changes to this Policy constitutes your acceptance of the updated Policy. We encourage you to review this Policy periodically.
